We are bound by the Privacy Principles (Principles) contained in the Privacy Act 2020 (Privacy Act) and where personal information comprises information about your health, we are bound by the Health Information Privacy Code (Code).

This Privacy Policy sets out the practices that we have adopted in compliance with the Principles, the Privacy Act and the Code so that you can be confident that we will appropriately manage and protect your privacy and the security of your personal information.

By accessing this website, including using our Symptom Tracker Tool (Symptom Tracker), you agree to our use of your personal information in accordance with this Privacy Policy.

References to the Privacy Act includes any subordinate legislation, by-law, regulation, order, statutory instrument or determination made under it, any re-enactment of, or amendment to, the Privacy Act and all legislation passed in substitution for that legislation.

Throughout this Privacy Policy we and us refers to Pharmaco (N.Z.) Limited (company number 19662), registered office 4 Fisher Crescent, Mount Wellington, Auckland, 1060, New Zealand, and its successors.

Collection of Information

Personal information is any information that can be used to identify you and may include your name, email address, physical and/or postal address and other contact details, information about your health (in particular your menopause journey) information about your symptoms, information as to whether you are taking any medications and your results recorded within the Symptom Tracker.

We will collect personal information when you access this website and use the Symptom Tracker.  Where you register to use the Symptom Tracker we will collect your name and contact details as well as information that you provide about your health.  Where you do not register to use the Symptom Tracker we will not collect your name and contact details.

We may also collect personal information about you when you make an inquiry or complaint.

You can decide whether to provide personal information but if you choose not to provide personal information when requested, we may be unable to respond to your inquiry or complaint or to provide you with the services you require.

We will also collect information about your device and information about how you use this website, including IP address, location information and search information.  Your access to this website may be monitored and tracked through the use of “cookies”.  We may use any information provided by you through your browser (including cookies) as we consider appropriate.  Without limitation, we may use cookies to remember your preferences and settings, enable us to improve the content, reliability and functionality of this website, enable you to use certain services or functionality and track and understand usage.  You may be able to set your browser to disable cookies but in some instances you may be required to accept certain cookies in order to use our services.

We will not disclose personal information about you or your browsing habits to any third party, without your permission unless required to do so by law.

Notwithstanding the above, you acknowledge that transmissions to and from this website may be monitored, intercepted or modified by other parties (for example by Google Analytics).

Use and Disclosure of Information

Any personal information we receive will be used as an informational and educational resource (including for you to provide to your healthcare professional) and to provide you with news and information about us and products, services and activities (if you have opted to receive such news and information), to respond to complaints, to improve this website and our products and services and for such other purposes as may be disclosed to you at the time the personal information is collected or as required by law.

Where you consent, we will also use your personal information to provide information to you about us, our products and services and any other important news or developments which we consider may be of interest to you.

We will not sell, trade or rent or give personal information to third parties (other than related entities), except to the extent that it is necessary for or incidental to the above purposes.  We may also share your personal information with third parties who provide services for us in connection with this website.

Security and Storage

We will take all reasonable steps to ensure the security and confidentiality of the information that is collected including encryption of personal information. We observe strict data handling and information security protocols.

Retention of Personal Information

We will keep your personal information only for as long as is reasonably necessary, having regard to the purpose of collection, and in accordance with applicable legal requirements.

Where you register to use the Symptom Tracker, your personal information including the results recorded within the Symptom Tracker will be retained and accessible within your account.  Where you do not register to use the Symptom Tracker, you will need to download the results recorded within the Symptom Tracker if you would like to keep them.

Access to and Correction of Personal Information

We want to make sure that your personal information is accurate, up to date, complete, relevant and not misleading.  You have the right in most cases to gain access to and request the correction of personal information that we hold about you by contacting us. We will deal with requests for access to and correction of personal information as quickly as possible.

You may also request the deletion of any personal information that you have provided through the Symptom Tracker.

Emails

Emails are regulated by the Unsolicited Electronic Messages Act 2007 and in compliance with this Act, we will not send you a commercial electronic message unless permitted to do so.

You can elect not to receive emails from us by choosing to opt out of any email subscription at any time via the link below.

Complaints

If you have any concerns or complaints about the manner in which your personal information has been collected or managed by us, please contact us.

We will endeavour to resolve any complaint to your satisfaction. However, if you are unhappy with our response, you may contact the Privacy Commissioner who may investigate your complaint further.
